Privacy Policy and Protection of Data Held by Private Parties
In order to guarantee the principle of information, privacy and the right to informational self-determination of the owners, ORLE ASESORES, S.C., with address at Vasco de Quiroga number 3900, Floor 10 Interior 10-b, Colonia Santa Fe Cuajimalpa, Alcaldía Cuajimalpa, Postal Code 05348, in Mexico City, (hereinafter “Orle”), in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the “Law”), and in its capacity as controller of the processing of personal data, informs the owner (hereinafter “User”) of its website (hereinafter the “Portal”) about the Privacy Policy and Protection of Personal Data that it will apply for the legitimate, controlled and informed processing of the personal data that the User voluntarily provides.
Orle may also collect the User’s IP address to manage the Portal. An IP address is a number assigned to a computer when using the Internet. The IP address is also used to help identify you within a particular session and to gather general demographic information. The information may include the URL you came from (whether or not it is on our Portal), which URL you next access (whether or not it is on our Portal), what browser you are using, as well as the pages visited, searches performed, publications, purchases or sales.
In terms of the Law, when the User accesses the Portal and provides his or her personal data to Orle, unless he or she states otherwise, the User tacitly consents to the processing of such data in accordance with the provisions of this Privacy Notice.
In compliance with the provisions of articles 15, 16 and other applicable articles of the Law, Orle makes this Privacy Notice available to you, which will be available at all times on our website: https://disandat.mx/ and https://e.commerce.com.mx/.
Express consent
The User, by providing Orle with his/her personal data through the electronic form on the Portal, expressly consents to this Privacy Notice and allows Orle to process said data in accordance with the terms of this Privacy Notice, Privacy Policy and Protection of Data Held by Private Parties.
The User authorizes Orle to provide information without his/her consent in the following cases: (i) when provided for by law; (ii) the data is contained in publicly accessible sources; (iii) the personal data is subject to a prior dissociation procedure; (iv) it is intended to fulfill obligations arising from a legal relationship between the owner and the person responsible; (v) there is an emergency situation that could potentially harm an individual in his/her person or property; or (vi) a resolution is issued by a competent authority; (vii) when the transfer is provided for in a law or treaty to which Mexico is a party; (viii) when the transfer is necessary or legally required to safeguard a public interest, or for the procurement or administration of justice; (ix) when the transfer is necessary for the recognition, exercise or defense of a right in a judicial process; (x) when the transfer is necessary for the maintenance or fulfillment of a legal relationship between the controller and the owner; and (xi) when requested by its commercial, technical or strategic partners, in order to offer better content and services to the User.
Contact Registration
Before contacting us through the Portal, the User must read this Privacy Notice, Privacy Policy and Protection of Data Held by Private Parties and accept it by checking the box on the registration form for contacting Orle. When filling out the form, the User must provide the following real data: full name, email, contact phone number, if applicable, the name of the company and the services required.
It is important to state that Orle is not requesting sensitive personal information from the User, as indicated in the Law in question.
The User undertakes to keep the data provided to Orle duly updated. The User will be responsible for any damages that Orle or third parties may suffer as a result of the lack of veracity, inaccuracy, lack of validity and authenticity of the data provided.
Federal Law on the Protection of Personal Data Held by Private Parties
Orle expresses its commitment to comply with the legislation in force at all times regarding data protection, specifically with the Law and other applicable legislation, as amended from time to time.
By contacting us through the Portal, the User expresses his or her express consent for the processing of personal data that will form part of a database owned by Orle for the purpose of managing the relationship with the User, as well as to keep him or her informed about news, products, offers and services of Orle through any channel, including electronic.
Use of data
By contacting us through the Portal, the User expressly authorizes Orle to use his or her personal data for internal statistical analysis or for any other research function that Orle may carry out in order to continue improving its products, services and the Portal. The foregoing with the sole purpose of properly carrying out Orle’s activities and provision of services, including, without limitation, personalizing, providing and improving our services, as well as contacting the User; the foregoing in order to satisfy the User’s requests for certain products and services, and to analyze how the User uses the services.
In addition, the User expressly allows Orle to collect information for traffic monitoring, with the intention of identifying groups and user profiles, as well as for advertising targeting purposes.
Cookies
The Portal makes use of cookies, which are small data files that are generated on your computer that send information, but without providing references that allow the visitor’s personal data to be deduced. You can configure your browser to notify you and reject the installation of cookies sent by the Portal, without affecting the ability to access the content. However, deactivating them could prevent the Portal from working properly.
Web Beacons
As with cookies, this Portal may also contain web beacons, an electronic graphic file that allows counting users who access the Portal or access certain cookies on it. In this way, Orle can offer you an even more personalized experience.
Receiving and sending emails
By contacting us through the Orle Portal, the User agrees to receive emails, SMS, push notifications, and notifications in known and unknown media. The User agrees to receive both mandatory notifications for the correct operation of the Portal, as well as those related to promotions and information of interest.
The User may choose to stop receiving emails and promotional notifications at any time by clicking on the unsubscribe link found in all emails. However, in no case may the User choose to stop receiving emails or notifications necessary for the correct operation of the Portal.
Security Measures and Levels
Orle has adopted the necessary measures to maintain the level of security required by the nature of the personal data processed and the circumstances of the processing, in order to avoid, as far as possible, its alteration, loss, processing or unauthorized access.
Orle has the necessary administrative, technical and physical security measures to safeguard the privacy and confidentiality of personal data, as well as to comply with the principles of personal data protection provided for in the Law.
However, it is important to bear in mind that perfect security does not exist on the Internet. Therefore, Orle is not responsible for illegal interceptions or violations of its systems or databases by unauthorized persons. Likewise, Orle is not responsible for the improper use of information obtained by these or other means.
Orle does not assume any obligation to keep confidential any other information that the User provides through newsletters or chats, as well as the information obtained through cookies, or any other information that has not been directly delivered to Orle.
In order to be able to comply with the purposes set forth in this Privacy Notice, when in Orle’s opinion it is necessary, certain personal data of users may be transferred to third parties, with Orle undertaking in all cases to ensure compliance with the principles of personal data protection established in the Law and to take the necessary and sufficient measures to guarantee that both the Law and this Privacy Notice are respected at all times by the third party or parties to whom Orle transfers the personal data.
In this regard, Orle may transfer the personal data of Users, among others, to its subsidiaries and affiliates, authorities and self-regulatory bodies and to third parties providing the services necessary for its proper operation and for the fulfillment of the purposes set forth in this Privacy Notice.
Unless the User states his/her opposition, it will be understood that he/she gives his/her consent to Orle to transfer his/her personal data to third parties, provided that this is necessary for the fulfillment of the purposes established in this Privacy Notice. The above, on the understanding that the third party recipient will assume the same responsibilities and/or obligations of Orle derived from this Privacy Notice, and must respect it at all times.
Exercise of Rights
In accordance with the provisions of the Law, as of January 6, 2018, the User will have the right, at all times, to access his/her personal data held by Orle, rectify them if they are inaccurate or incomplete, instruct us to cancel them when he/she considers that they are excessive or unnecessary for the purposes that justified their obtaining or the contractual relationship with Orle has ended, as well as to oppose for legitimate reasons the processing of his/her personal data.
Likewise, the User may exercise the rights of access, rectification, cancellation and opposition (the “ARCO Rights”) referred to above, in compliance with the provisions of the Law.
The exercise of these rights must be made in writing to Orle and must include the following:
• Full name and address or any other means to communicate the response;
• Clear and precise description of the personal data in respect of which one seeks to exercise any of the rights of access, rectification, cancellation or opposition to them;
• Signature of the owner of the rights in question;
• Addressed to Orle;
• Attach a copy of documentation that proves the identity of the owner of the rights and/or his/her legal representative; and
• In the case of requests for rectification, you must also indicate the modifications to be made and provide the documentation that supports your request, if it is appropriate.
The request must be sent to Orle at the email address: [email protected] indicating “Data Protection” in the subject. Orle will inform the User, within a period of 20 (twenty) business days from the date the request was received, of the decision adopted. Once the response has been sent within the indicated period, Orle will have 15 (fifteen) business days to execute the Access, Rectification, Cancellation or Opposition of the personal data in accordance with the request.
Limitation of Use and Disclosure of Personal Data
In addition to the aforementioned rights, the User will have, at all times, the right to limit the use or disclosure of his or her personal data, as well as the right to stop receiving promotional messages or advertising.
In order to exercise this right, the respective request must be sent to our Specialized User Service Unit at the email address and with the requirements indicated for the exercise of ARCO Rights, when applicable.
Revocation of Consent for the Processing of Personal Data
Likewise, the User will have, at all times, the right to revoke the consent granted to Orle for the processing of his or her personal data in terms of the provisions of this Privacy Notice, without retroactive effects being attributed to the revocation.
In order to exercise this right, the respective request must be sent to our Specialized User Service Unit at the email address and with the requirements indicated for the exercise of ARCO Rights, when applicable.
Modifications to the Privacy Notice
Orle reserves the right to make, at any time, modifications or updates to this Privacy Notice, whether as a result of legislative reforms, internal policies, new requirements for the provision or offering of our services and/or products, market practices or others. Such modifications will be deemed accepted if the User does not express his/her disagreement with them within a period of 3 (three) days from the date they have been made.
The modifications or updates will be incorporated into this Privacy Notice and will be available on the Portal, or will be sent to the last email address that you have provided us.
Complaints and Reports
In the event that the User considers that the right to the protection of his/her personal data has been violated by any conduct of our employees or by the actions of Orle and, therefore, presumes that there is a violation of the provisions set forth in the Law, he/she may file the corresponding complaint with the National Institute of Transparency, Access to Information and Protection of Personal Data.
